Terms of Service

These Terms of Service ("Terms") govern your access to and use of Hyper (the "Service"), operated by Shuttle Technologies, Inc. d/b/a Hyper ("Hyper," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Hyper is an AI-native video conferencing platform that enables users to host and join real-time video conferencing meetings, including video, audio, chat, and screen sharing functionality.

Meeting participants may join meetings without creating an account. Creating and hosting meetings requires an account.

2. Eligibility

You must be at least 13 years old to use the Service. The Service is not intended for children under 13.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts and Authentication

To access certain features, users may be required to create an account. Hyper supports authentication via:

  • Email and password
  • Magic link
  • Google Sign-In
  • Microsoft Sign-In (OAuth)

You are responsible for safeguarding your credentials and for all activity under your account.

4. User Content

The Service enables users to transmit and process content, including video streams, audio streams, chat messages, and screen shares ("User Content").

You retain ownership of your User Content. By using the Service, you grant Hyper a limited, non-exclusive, worldwide license to process, transmit, store, and display User Content solely to operate, maintain, and improve the Service.

Hyper does not use User Content for advertising purposes.

5. Acceptable Use

You agree not to:

  • Use the Service in violation of applicable laws or regulations
  • Infringe upon the rights of others
  • Disrupt or interfere with the Service or its infrastructure
  • Transmit malware or abusive content

Hyper may suspend or terminate access for violations of these Terms.

6. Availability

The Service is provided "as is" and "as available." Hyper does not guarantee uninterrupted or error-free operation and may modify or discontinue features at any time.

7. Intellectual Property

Except for User Content, all rights in the Service are owned by Hyper or its licensors. You may not copy, modify, or distribute the Service without authorization.

8. Disclaimers

To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Hyper shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service.

10. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.
